What to do if someone asks to buy your domain.

This form is designed to help you understand some of the risks involved in bargaining for your domain. Unfortunately, at this time, it only applies to top-level domains that are within the United States jusridiction, i.e. .com, .org, .net, .us, etc.

Often requests to purchase your domain come from genuinely interested buyers. Some of the time, offers to buy your domain are from lawyers or those who are wanting to steal your domain through ICANN UDRP arbitration. How you respond to this seemingly innocent query makes a huge difference whether you keep, sell or lose your domain.

If the offer came from someone who is trying to steal your domain, unless you are a habitual cybersquatter, they will have very little evidence against you at this point. The main goal of asking to buy your domain is to gather evidence that they can later use against you.

I recommend treating all inquiries as if they where brought in bad-faith.

First some background questions:

  4. If there was an offer made, who initiated it?

  5. What was your purpose in registering the domain?
    1. I registered the domain in order to use it for a personal or noncommercial site
    2. I registered the domain to be used in a business
    3. I registered the domain in order to sell or rent it
    4. I have not decided on how I'm going to use the domain

  6. What is the current state of the domain as it relates to the web?
    1. There is a web site connected to the domain
    2. I have not had a chance to put a web page up on this domain yet
    3. People who go to this domain will be redirected to another site
    4. The "default" page is still up from when I first registered it

  7. At the time you registered the domain, did you know of any trademarks or companies that use any part of your domain in their name, products or services?
